IMPORTANT NOTICE: PLEASE READ THESE TERMS CAREFULLY BEFORE USING BUDDYCALLAI. BY REGISTERING AN ACCOUNT, MAKING A CALL, OR OTHERWISE USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and BuddyCallAI, operated by Brash3d Media Group ("Company," "we," "us," or "our"), governing your use of the BuddyCallAI AI telephone assistant service, website, and all related features ("Services").
If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not have such authority, or if you do not agree with these Terms, you must not use our Services.
2. Eligibility & Account Requirements
- You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to create an account
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized use of your account
- You may not create multiple accounts to circumvent usage limits or bans
- One registered phone number per Starter plan; 3 per Pro plan; 6 per Gold plan
3. Description of Services
BuddyCallAI provides an AI-powered voice assistant accessible by dialing a dedicated telephone number in your country. The Service allows you to have natural-language voice conversations with an artificial intelligence system powered by leading AI providers including OpenAI, Anthropic, and Google.
3.1 What the Service Is
- A telephone-accessible AI conversation assistant available 24 hours a day, 7 days a week
- Available to account holders in the United States and Canada (our current service area)
- Capable of answering questions, providing information, offering assistance, and engaging in conversation
- Powered by professional voice synthesis (ElevenLabs) and speech recognition (Deepgram) technology
3.2 What the Service Is NOT
- NOT a substitute for professional medical, legal, financial, psychological, or emergency advice
- NOT a licensed counseling, therapy, or mental health service
- NOT an emergency response service — call 911 (USA), 999 (UK), 112 (EU), or your local emergency number for emergencies
- NOT guaranteed to be error-free — AI systems can make mistakes and provide inaccurate information
3.3 Voice Conversations, Transcripts, and Recordings
IMPORTANT NOTICE: When you use BuddyCallAI by telephone, we process your voice audio in real time to deliver the Service. We may generate text transcripts of your conversations using automated speech recognition (for example, Deepgram). We may retain call metadata (date, time, duration, phone numbers) and transcripts as described in our Privacy Policy. Where call recordings are stored, they are retained only for the limited periods stated in the Privacy Policy and are used solely to operate, secure, and improve the Service — not for advertising or resale.
By registering an account and placing calls, you acknowledge that AI voice interactions and related transcript data will be processed as described in our Privacy Policy.
4. Call Quality & Service Limitations
IMPORTANT NOTICE — CALL QUALITY DISCLAIMER: The quality, clarity, and reliability of calls made through BuddyCallAI are subject to and dependent upon the quality of service provided by third-party telecommunications providers (including Twilio) and the strength, stability, and quality of your cellular or landline signal at your location. BuddyCallAI makes no guarantee of call quality and is not liable for poor call quality resulting from network conditions, cellular signal strength, geographic location, carrier limitations, or any other telecommunications infrastructure factors outside our direct control.
Specifically, the following factors may affect your call experience and are outside our control:
- Cellular signal strength at your current location
- Your mobile carrier's network coverage and congestion
- Landline or VoIP connection quality
- Internet connectivity of the infrastructure serving your region
- Interference, atmospheric conditions, or geographic barriers affecting signal
- Maintenance, outages, or disruptions by third-party providers (Twilio, ElevenLabs, Deepgram, AWS)
- Latency introduced by international call routing
We strive to maintain 99.9% platform uptime but cannot guarantee uninterrupted service due to factors beyond our control. In cases of provider outages, we will endeavor to communicate status updates at www.buddycallai.com/status.
5. Subscription Plans, Billing & Refunds

5.2 Billing Terms
- All prices are in USD. Applicable taxes may be added based on your jurisdiction
- Subscriptions are billed monthly, beginning on the date of your initial payment
- Your subscription automatically renews each month unless cancelled
- Talk time is allocated on a monthly basis and does not roll over to the next billing period
- Call minutes are deducted in real time during calls. Once your allocation is exhausted, your call will be ended
- You will receive SMS warnings at 5 minutes and 2 minutes before your time runs out
- Additional time may be purchased as a one-time recharge from your account dashboard at www.buddycallai.com/app/billing
5.3 Cancellation
- You may cancel your subscription at any time through your dashboard or by contacting support
- Cancellation takes effect at the end of your current billing period — you retain access until then
- No refunds are issued for partial months or unused talk time upon cancellation
5.4 Refund Policy
- Full refund within 48 hours of initial purchase if no calls have been made
- No refunds after 48 hours or after any call minutes have been used
- In cases of significant platform outage (more than 4 hours in a billing month), affected users may receive pro-rated credit at our discretion

6. Acceptable Use Policy
You agree to use BuddyCallAI only for lawful purposes and in a manner that does not infringe the rights of others. The following uses are strictly prohibited:
6.1 Prohibited Activities
- Using the Service to make harassing, threatening, abusive, or offensive calls
- Attempting to extract harmful information, including instructions for illegal activities, weapons manufacturing, drug synthesis, or other dangerous content
- Impersonating any person or entity, or misrepresenting your affiliation with any organization
- Using the Service to conduct fraud, phishing, social engineering, or other deceptive practices
- Attempting to reverse-engineer, circumvent, or bypass our AI safety systems
- Using the Service to record and redistribute AI conversations without our written permission
- Using automated dialing systems or bots to interact with the Service
- Attempting to access other users' accounts, data, or call transcripts
- Reselling or sublicensing access to the Service without written authorization
- Using the Service in any way that could damage, disable, or impair our infrastructure
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
7. AI Content Disclaimer & Limitations
IMPORTANT NOTICE: AI-generated responses are not always accurate, complete, or current. Do not rely on BuddyCallAI for medical diagnosis, legal advice, financial decisions, emergency guidance, or any other matter where professional expertise is required.
- BuddyCallAI is powered by third-party AI models (OpenAI, Anthropic, Google) and we do not control the underlying model behavior
- AI responses may occasionally be incorrect, outdated, biased, or inappropriate despite our safety measures
- We are not responsible for actions you take based on information provided by the AI assistant
- The AI assistant does not retain memory between separate calls — each new call starts fresh
- We continuously work to improve response quality and safety but cannot guarantee perfection
8. Intellectual Property
- The BuddyCallAI name, logo, website, and platform are the exclusive intellectual property of Brash3d Media Group
- Call transcripts generated during your use of the Service are provided to you for personal use only
- You retain ownership of the content you speak during calls; however, you grant us a limited, non-exclusive license to process your voice data to deliver the Service
- You may not reproduce, distribute, or create derivative works from our platform, brand, or content without written permission
9. Limitation of Liability
IMPORTANT NOTICE: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUDDYCALLAI AND BRASH3D MEDIA GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES.
Our total cumulative liability to you for any claims arising from your use of the Service shall not exceed the total amount you paid to BuddyCallAI in the three (3) months preceding the claim.
This limitation applies regardless of the form of action, whether in contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify, defend, and hold harmless BuddyCallAI, Brash3d Media Group, and their respective officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms of Service
- Your violation of any applicable law or third-party rights
- Your use of the Service in a manner not authorized by these Terms
- Any content you provide through the Service that causes harm to a third party
11. Governing Law & Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law provisions. Users in jurisdictions with mandatory local consumer protection laws retain the protections afforded by those laws.
11.2 Dispute Resolution
- Before initiating formal proceedings, you agree to contact us at legal@buddycallai.com to attempt to resolve any dispute informally within 30 days
- If informal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
- Arbitration shall take place in Orlando, Florida, USA, or via video conference
- You waive your right to participate in class action lawsuits or class-wide arbitration
- Users in the EU/UK retain the right to bring claims before their local courts regardless of this provision
12. Termination
12.1 Termination by You
You may terminate your account at any time by cancelling your subscription through your dashboard or by contacting support@buddycallai.com. Account deletion requests will be processed within 30 days.
12.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, without notice or refund, if you:
- Violate these Terms of Service or our Acceptable Use Policy
- Engage in fraudulent, abusive, or illegal activity
- Attempt to harm our systems, other users, or third parties
- Fail to pay subscription fees when due
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email at least 14 days before taking effect. Your continued use of the Services after the effective date of changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must cancel your account before the changes take effect.
14. Entire Agreement & Severability
These Terms, together with our Privacy Policy and any additional terms incorporated by reference, constitute the entire agreement between you and BuddyCallAI regarding the Services. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
